1.1 Overview of the Service

MotionForge is an AI-powered platform that allows users to upload longform videos, automatically split them into shortform clips, and generate AI hooks, captions, and templates. The Service operates on a credit-based usage model and may include access to a digital course and template library.

1.2 Eligibility

You must be at least 18 years old to use the Service.

1.3 Digital Product Nature

MotionForge provides digital products and services only. No physical goods are shipped. Because access and value are delivered instantly:

• All sales are final.
• No refunds are offered except where required by law.
• Credits, AI outputs, and course access are digital in nature.

1.4 Service Availability

We aim for high uptime, but we do not guarantee uninterrupted access, zero errors, or permanent storage of uploaded content. You are responsible for backing up your own files and outputs.

1.5 No Guarantees

MotionForge does not guarantee virality, reach, sales, views, subscribers, or any form of financial or business outcome. AI outputs must always be reviewed by you before use.

2.1 Prohibited Content

You may not upload, generate, or process any content that includes:

• Illegal material of any kind.
• Sexual content involving minors or any form of child exploitation.
• Non-consensual pornography or revenge porn.
• Extremist, terrorist, or violent propaganda.
• Copyrighted materials that you do not own or have permission to use.
• Graphic violence, self-harm promotion, or abuse.
• Hate speech or content that promotes discrimination or harm.
• Any content that violates local or international law.

2.2 AI-Related Misuse

You may not use MotionForge to:

• Create deceptive deepfakes intended to mislead or harm others.
• Generate harassment, defamation, or targeted abuse.
• Automate spam, scams, or fraudulent behavior.
• Produce misleading political or medical content presented as authoritative advice.

2.3 Technical Misuse

You may not attempt to:

• Reverse-engineer, copy, or replicate the platform or backend.
• Bypass credit limits, usage tracking, or security systems.
• Overload or disrupt servers or infrastructure.
• Scrape or systematically harvest our content, code, or models.

3.1 Automated Detection

MotionForge uses automated filters and safety systems to detect certain categories of prohibited content (including nudity, violence, child safety risks, copyright signals, and other policy violations).

3.2 Actions We May Take

If a violation is detected or reasonably suspected, MotionForge may, at its sole discretion:

• Block or reject uploads.
• Restrict, suspend, or terminate access to the Service.
• Forfeit credits that were used in connection with the violation.
• Report content to relevant authorities where legally required.

3.3 Monitoring Disclaimer

MotionForge is not obligated to monitor all content and does not guarantee that all violations will be detected. However, we reserve the right to review and act on content when violations are identified.

4.1 Credits System

MotionForge uses credits (“MF Credits”) to control and measure usage of certain features, including but not limited to:

• Video splitting and processing.
• AI caption, hook, and hashtag generation.
• Template usage and experimentation.

Credits are:

• Non-refundable.
• Non-transferable.
• Consumed when actions are processed, even if results are not as expected.
• Subject to expiration policies announced within the product, especially after beta.

4.2 Payments

Payments are processed by third-party providers such as Stripe. By purchasing, you confirm that you are authorized to use the chosen payment method and understand that digital products are delivered instantly.

4.3 General Refund Policy

Because MotionForge provides digital, instantly usable products (including credits, templates, AI features, and access to digital courses):

• All sales are considered final.
• We generally do not offer refunds.
• Refunds are only considered if required by applicable law.

Abuse, violation of policies, or misuse of the Service automatically voids any right to a refund.

4.4 Misuse and Credit Forfeiture

If you use MotionForge for prohibited or illegal content, or otherwise violate these Terms or the Acceptable Use Policy:

• Credits used for those actions will not be returned.
• Remaining credits may be forfeited.
• Access may be restricted or terminated.

5.1 AI Output Disclaimer

AI-generated hooks, captions, suggestions, and templates may contain inaccuracies, biases, or incomplete information. They are intended as creative assistance only and must be reviewed and edited by you.

5.2 No Professional Advice

AI outputs from MotionForge do not constitute legal, financial, medical, or professional advice. You are solely responsible for any decisions you make based on the content provided.

5.3 Limitation of Liability

To the maximum extent permitted by law, MotionForge B.V. is not liable for any:

• Lost profits, revenue, or business opportunities.
• Loss of data, videos, or content.
• Indirect, incidental, or consequential damages.

The total liability of MotionForge B.V. for any claim shall not exceed the total amount you paid for the Service.
